Ռոբերտ Հայրապետյանը ֆեյսբուքյան իր էջում  հրապարակել է 168.am-ին տրված հարցազրույցի հղումը եւ մեկնաբանել` «Կարեւոր» 

Պարզվում է՝ հոկտեմբերի 1-ից հետո աշխատող քաղաքացիների կողմից, որպես պատվաստմանն այլընտրանք ներկայացվող 72-ժամյա վաղեմության ՊՇՌ բացասական թեստ հանձնելու անհրաժեշտություն հենց հոկտեմբերի 1-ին, չկա: Այս մասին 168.am-ի հետ զրույցում ասաց իրավաբան Ռոբերտ Հայրապետյանը:

Հիշեցնենք, որ ՀՀ առողջապահության նախարարի 20.08.2021 թվականի հրամանը, որով ՀՀ առողջապահության նախարարի 2020 թվականի օգոստոսի 4-ի թիվ 17-ն եվ 2020 թվականի սեպտեմբերի 18-ի թիվ 24-ն հրամաններում փոփոխություններ և լրացումներ են կատարվել, սահմանում է, որ աշխատողները յուրաքանչյուր 14 օրը մեկ ներկայացնում են կորոնավիրուսային հիվանդության (COVID-19) ախտորոշման պոլիմերազային շղթայական ռեակցիայի հետազոտության (այսուհետ` ՊՇՌ հետազոտություն) բացասական արդյունքը հավաստող առավելագույնը 72 ժամ վաղեմության թեստ:

«Հրամանի եզրափակիչ մասում նշված է, որ այն ուժի մեջ է մտնում 2021 թվականի հոկտեմբերի 01-ից: «Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքի 28-րդ հոդվածը սահմանում է, որ նորմատիվ իրավական ակտի գործողությունը տարածվում է դրա ուժի մեջ մտնելուց հետո գործող հարաբերությունների վրա, այս պարագայում՝ հոկտեմբերի 1-ից հետո ծագող հարաբերությունների վրա»,- օրենքը մեկնաբանեց Ռոբերտ Հայրապետյանը:

Իրավաբանի խոսքով՝ «Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքի 31-րդ հոդվածը սահմանում է, որ օրերով հաշվարկվող ժամկետների ընթացքն սկսվում է այն օրացուցային ամսաթվի հաջորդ օրվանից, որով որոշված է դրա ժամկետի սկիզբը: Այսինքն՝ 14 օրը մեկ թեստ հանձնելու պարտավորության 14-օրյա հաշվարկը սկսվում է հրամանն ուժի մեջ մտնելու հաջորդ օրվանից՝ հոկտեմբերի 2-ից:

«Ըստ նույն օրենքի՝ օրերով հաշվարկվող ժամկետը լրանում է այդ ժամկետի վերջին օրը, այսինքն՝ հոկտեմբերի 15-ին, հետևաբար՝ քաղաքացիների համար բացասական արդյունքով ՊՇՌ թեստ ներկայացնելու պարտավորությունը սկսվում է հոկտեմբերի 15-ից, և մինչև այդ ժամկետը թեստի պահանջ ներկայացնելն անօրինական է»,- եզրափակեց Ռոբերտ Հայրապետյանը:
