Ինչո՞ւ է դատախազը խուսափում քրեական հետապնդում սկսել Ադրբեջանի ռազմաքաղաքական ղեկավարության նկատմամբ

ՀՀ ԱԺ Մարդու իրավունքների և հանրային հարցերի մշտական հանձնաժողովի նախագահ Թագուհի Թովմասյանը ֆեյսբուքյան էջում գրել է.

«Երեկ ՀՀ Դատախազությունը հաղորդագրություն է տարածել այն մասին, որ «Ադրբեջանական զինված ուժերի կողմից ՀՀ-ի նկատմամբ ռազմական ագրեսիայի ակտ իրականացնելու և միջազգային հումանիտար իրավունքի աղաղակող խախտումների առթիվ քրեական գործ է հարուցվել»։

Դեռ նախորդ տարվա նոյեմբերի 20-ին գրություն էի ուղարկել ՀՀ գլխավոր դատախազին՝ խնդրելով հայտնել՝ պատերազմի ընթացքում և դրանից հետո հարուցված քրեական գործերի շրջանակներում ինչ գործողություններ են արվել։ Պատասխան գրության մեջ ասվում էր, որ հարուցվել է քրեական գործ Ադրբեջանի ռազմաքաղաքական ղեկավարության կողմից միջազգային կոնվենցիաների խախտմամբ, մարդկության դեմ կատարվող հանցագործություններ կատարելու փաստերի կապակցությամբ, սակայն մեղադրանք էր առաջադրվել և քրեական գործ հարուցվել միայն Ադրբեջանի ֆուտբոլային ակումբի մեկնաբանի նկատմամբ։

Սեպտեմբերին ևս հարցում էի ուղարկել ՀՀ գլխավոր դատախազին՝ խնդրելով պարզաբանել, թե արդյոք պատերազմի ավարտից հետո Հայաստան ներխուժելու ադրբեջանական գործողություններում կա՞ն հանցագործության դրսեւորումներ, թե՞՝ ոչ: Եթե ՝այո, ապա ի՞նչ միջոցներ են ձեռնարկվել: Ի պատասխան՝ կրկին ստացա բազմաբովանդակ տեղեկություն, որ տարբեր օրերին հարուցվել են քրեական գործեր, սակայն՝ «…Նախաքննությունը շարունակվում է, գործերով որպես մեղադրյալներ ներգրավված անձինք չկան»:

Մինչ այսօր ինձ հետաքրքրում է, թե ինչու է դատախազը խուսափում քրեական հետապնդում սկսել Ադրբեջանի ռազմաքաղաքական ղեկավարության նկատմամբ, ինչու հետախուզում չի հայտարարվում ադրբեջանական պաշտոնյաների նկատմամբ՝ առնվազն Ադրբեջանի Պաշտպանության նախարարի, ինչու չի սահմանափակվում նրանց ազատ տեղաշարժի իրավունքը այն դեպքում, երբ նրանք հայտարարել են, որ իրենց կողմից միջազգային հետախուզման է ենթարկվել մոտ երեք հարյուր հայ, և նրանց մեջ է պաշտպանության նախկին նախարար Սեյրան Օհանյանը, Արցախի նախագահ Արայիկ Հարությունյանը, Ջալալ Հարությունյանը, Արցախի ԱԳՆ Դավիթ Բաբայանը։

Վերլուծելով վերոգրյալը՝ մի հարց է առաջանում. երեկվա դեպքերի առիթով հարուցված հերթական «հուժկու քրեական գործի» շրջանակներում ադրբեջանական ո՞ր ֆուտբոլային ակումբի մամուլի խոսնակի նկատմամբ է դատախազությունը միջազգային հետախուզում հայտարարելու»։
