ԱԱԾ-ն առաջարկում է խստացնել սփյուռքահայերի համար ՀՀ քաղաքացիություն ստանալու կարգը

Ազգային անվտանգության ծառայությունը առաջարկում է ազգությամբ հայ ՀՀ քաղաքացիություն չունեցող անձի կողմից ՀՀ քաղաքացիություն ձեռք բերելու համար որպես պարտադիր պահանջ սահմանել Հայաստանում վերջին երկու տարվա ընթացքում առնվազն 60 օր օրինական հիմքով բնակվելու կամ գտնվելու հանգամանքը:

Սահմանադրությամբ ազգությամբ հայերը Հայաստանում բնակվելու պահից ունեն ՀՀ քաղաքացիություն ձեռք բերելու իրավունք, սակայն «Քաղաքացիության մասին» օրենքով սահմանված չէ, թե որ պահից է անձը համար¬վում Հայաստանում բնակություն հաստատած:

«Մասնավորապես, ՀՀ քաղաքացիություն չունեցող 18 տարին լրացած, գործունակ, օտարերկրյա պետությունում բնակվող կամ Հայաստանում օրինական հիմքով բնակվող (գտնվող) յուրաքանչյուր անձ իրա¬վունք ունի դիմելու ՀՀ քաղաքացիություն ստանալու համար, եթե օրենքով սահմանված կարգով վերջին երեք տարին մշտապես բնակվել է Հայաստանում: Սահմանվում է, որ ՀՀ քաղաքացիություն չունեցող ազգությամբ հայ անձը, որի խնամակալը ՀՀ քաղաքացի է, կարող է ստանալ քաղաքացիություն առանց վերոհիշյալ պահանջների պահպանման: ՀՀ քաղաքացիություն ստանալու գործընթացում օրենքն առավել մեծ հնարավորություն է սահմանել ազգությամբ հայերի համար, քան ամրագրված է Սահմանադրությամբ»,- ասված է հիմնավորման մեջ։

Գործող օրենքի նկատակը, ըստ ԱԱԾ-ի՝ հայրենադարձությունը խթանելն է, սակայն ծառայության կողմից վերջին տարիներին կատարված ուսումնասիրությունների արդյունքում պարզվել է, որ ազգությամբ հայ հանդիսանալու հանգամանքով պայմանավորված ՀՀ քաղաքացիություն հայ¬ցող անձանց մի ստվար զանգվածը, հատկապես Մերձավոր Արևելքի երկրների՝ Սիրիայի, Լիբանանի, Հորդանանի քաղաքացիները, երբևէ չեն եղել Հայաստանում կամ ժամանել են հազվադեպ` 4-5 տարին մեկ անգամ․ «Իսկ որոշ դեպքերում ժամանել են միայն ՀՀ քաղաքացիություն հայցելու նպատակով և, որպես կանոն, չեն իրականացնում հայանպաստ գործունեություն։ Բացի այդ, եղել են նաև դեպքեր, երբ քաղաքացիություն ստանալուց հետո ՀՀ քաղաքացու անձնագրերը օգտագործել են միայն այլ պետություններ ճամփորդելու հնարավորություն ունենալու համար»։

ԱԱԾ-ն հանգել է այն եզրակացության, որ ազգությամբ հայերի համար սահմանված խրախուսող նորմերը փաստացի ոչ ամբողջապես են ապահովում օրենքում ներդրված նպատակների իրականացումը:

«Ակնհայտ է, որ օտարերկրյա պետությունների դեպքում, հատկապես առանձին դեպքերում ներքաղաքական սուր լարվածության և ռազմական գործողությունների գոտիներում, ՀՀ ազգային անվտանգության ծառայության կողմից սահմանափակ ռեսուրսներով, կարճ ժամկետներում ՀՀ քաղաքացիություն հայցող անձի ներկայացրած կենսագրական տվյալների, այդ թվում` ազգությամբ հայ լինելու փաստի արժանահավատության անհրաժեշտ խորը և բազմակողմանի ստուգում իրականացնելը հաճախ անիրատեսական է դառնում»,- նշված է հիմնավորման մեջ։
