Ադրբեջանցիներն ավերել են Հադրութի Ուխտաձոր գյուղի՝ Արցախյան ազատամարտին նվիրված հուշարձանը և խաչքարը: Այս մասին գրում է Արցախի մշակութային ժառանգության մշտադիտարկում իրականացնող monumentwatch.org կայքը:

«2023 թվականի սեպտեմբերի 7-ին թելեգրամյան ալիքներից մեկում տարածվեց մի տեսանյութ, որտեղ հստակ երևում է, որ Ադրբեջանի կողմից բռնազավթված Հադրութի շրջանում շարունակվում է հայկական մշակութային ժառանգության ոչնչացումը։ Տեսանյութը հստակ արձանագրում է, որ  ոչնչացված և գետնին է տապալված Արցախի Հադրութի շրջանի Ուխտաձոր գյուղի՝ Արցախյան ազատամարտին նվիրված հուշարձանը, ջարդուփշուր են արված հուշարձանի առանձին մասերը։ Հիշեցնենք, որ ավելի վաղ, դեռևս 2021 թվականին,  ադրբեջանական վանդալիզմի արդյունքում ոչնչացվել էր նույն մշակութային համալիրի մաս կազմող խաչքարը։ Այս շարունակական և միասնական շղթայի մաս կազմող գործողություններն ապացուցում են այն, որ մշակութային ժառանգության ոչնչացումն Ադրբեջանի կողմից հստակ մշակված ռազմավարություն է։

Մեր արձագանքը

Միջազգային մարդասիրական իրավունքի շրջանակներում մշակութային ժառանգությունը համարվում է մարդու ստեղծագործ մտքի բացառիկ արտահայտություն, որի ոչնչացումը կամ վնասումը ուղղակիորեն խախտում է մարդու/համայնքի անդամների մշակութային իրավունքները թեˊ պատերազմի ժամանակ, թեˊ պատերազմից հետո։

Միջազգային քրեական դատարանի 8-րդ հոդվածը օկուպացված տարածքներում  մշակութային ժառանգության ոչնչացումը միջազգային ռազմական հանցագործություն է համարում․ «Արգելվում է դիտավորյալ ուղղորդել հարձակումները կրոնին, կրթությանը, արվեստին, գիտությանը կամ բարեգործական նպատակներին նվիրված կառույցների, պատմական հուշարձանների, հիվանդանոցների, վրա, եթե դրանք ռազմական թիրախներ չեն»:

Զինված բախումների ժամանակ և դրանից հետո՝ օկուպացված տարածքներում մշակութային ժառանգության ոչնչացումն արգելված է նաև ՅՈՒՆԵՍԿՕ-ի կողմից 2003 թ. ընդունված «Մշակութային ժառանգության դիտավորյալ ոչնչացման մասին հռչակագրով»։

Զինված բախումների դեպքում մշակութային արժեքների պաշտպանության Հաագայի 1954 թվականի կոնվենցիայի 1999 թվականի երկրորդ արձանագրությունն իր 9-րդ հոդվածով նույնպես արգելում է մշակութային արժեքների ոչնչացման գործողությունները թշնամու վերահսկողության տակ գտնվող  տարածքներում»։
