Ներկայումս, ցավոք, նկատվում է՝ պարտադիր զինվորական կամ այլընտրանքային ծառայության հայտարարված զորակոչից և վարժական հավաքներից խուսափելու դեպքերի աճ: Այս մասին պետաիրավական հանձնաժողովի նիստին ասաց Արդարադատության նախարարի տեղակալ Գևորգ Քոչարյանը՝ «Հայաստանի Հանրապետության քրեական օրենսգրքում փոփոխություններ կատարելու մասին Հայաստանի Հանրապետության օրենքի նախագծի» հարցի քննարկման ժամանակ:

Նրա խոսքով՝ 2023 թվականի ընթացքում քրեական օրենսգրքի 461-րդ (պարտադիր զինվորական կամ այլընտրանքային ծառայության հայտարարված զորակոչից խուսափել) և 462-րդ (վարժական հավաքից խուսափել) հոդվածներով նախաձեռնվել է ընդհանուր 1,499 քրեական վարույթ, իսկ արդեն 2024 թվականի ընթացքում՝ ընդհանուր 1,779 քրեական վարույթ։

«Ընթացիկ տարվա հետ կապված վիճակագրություն դեռևս չունենք, ցավոք սրտի։ Սա վկայում է քրեական քաղաքականության վերանայման և հիշյալ արարքները կատարած անձանց նկատմամբ պատժողական ավելի խիստ քաղաքականություն վարելու անհրաժեշտության մասին։ Նախագծով առաջարկվում է խստացնել քրեական օրենսգրքի 461-րդ հոդվածի առաջին մասով և 462-րդ հոդվածի առաջին մասով նախատեսված արարքների կատարման համար նախատեսված քրեական պատասխանատվությունը։ Մասնավորապես, նախագծով առաջարկվում է զինվորական ծառայությունից խուսափելու հոդվածում 461-րդ հոդվածում պատժաչափը երկուսից հինգ տարի ժամկետով ազատազրկումը փոխարինել երեքից վեց տարի ժամկետով ազատազրկմամբ»,- ասաց փոխնախարարը:

Նա տեղեկացրեց, որ վարժական հավաքներից խուսափելու հոդվածում առաջարկվում է սանկցիայի տուգանք պատժատեսակի չափը ամսական եկամուտի նկատմամբ հաշվարկվող առավելագույնը 20-ապատիկի չափով բառերը փոխարինել 15-ապատիկից 30-ապատիկի չափով, իսկ ազատազրկման համար նախատեսված առավելագույնը երկու տարի ժամկետով փոխարինել մեկից երեք տարի ժամկետով բառերով։

«Գտնում ենք, որ նման փոփոխությունները կարող են նպաստել պարտադիր զինվորական կամ այլընտրանքային ծառայության հայտարարված զորակոչից և վարժական հավաքներից խուսափելու դեպքերի նվազմանը։ Բացի այդ, նախագծի ընդունման դեպքում քրեական օրենսգրքի 461-րդ հոդվածի առաջին մասը միջին ծանրությունից կդառնա ծանր հանցագործություն, ինչը հնարավորություն կտա իրավապահ մարմիններին պարտադիր զինվորական կամ այլընտրանքային ծառայության կամ արված զորակոչից խուսափելու հանցակազմի հասարակ տեսակի դեպքում ևս գործադրել օպերատիվ հետախուզական գործունեության մասին օրենքով և քրեական դատավարության օրենսգրքով նախատեսված օպերատիվ հետախուզական մի շարք միջոցառումներ և գաղտնի քննչական գործողություններ, ինչը ներկայումս հնարավոր չէ, քանի որ միջին ծանրության հանցակազմ է իրենց ներկայացնում»,- ասաց նա։
