ԱՃԹՆ արդյունաբերական խմբակցությունը բարձր է գնահատում Արդյունահանող ճյուղերի թափանցիկության նախաձեռնության շրջանակներում պետական լիազոր մարմինները և քաղաքացիական հասարակությունը ներկայացնող խմբակցությունների հետ տարիների համատեղ,արդյունավետ աշխատանքը։ Համոզված ենք, որմիասին անցած ճանապարհը, կառուցողականհամագործակցությամբ ամրապնդված փոխըմբռնումը հիմք է տալիս խմբակցությունների միջև հնարավոր տարաձայնությունները քննարկել անկեղծ և հանրության համար թափանցիկ երկխոսության ձևով։ Սրանից ելնելով՝ անհրաժեշտ ենք համարում արձագանքել ԱՃԹՆ քաղաքացիական հասարակության խմբակցության վերջին հայտարարությանը, որում «Զանգեզուրի պղնձամոլիբդենային կոմբինատ» ՓԲ ընկերության(ԶՊՄԿ) հայցն ընդդեմ նախկին աշխատողների համարվել է «անընդունելի» և որակվել որպես ռազմավարական հայց ընդդեմ հանրային մասնակցության։ Մի քանի այլ դրվագներով և հայտարարություններով այդ քաղ հասարակությաններկայացուցիչները հանքարդյունահանող ընկերությունների դատական հայցերը՝զրպարտության մեղադրանքով, որակել են որպես քաղաքացիական հասարակության ճնշման փորձեր։

Փաստերը հետևյալն են․ ԶՊՄԿ-ն բազմիցս հայտարարել է, որ այս տարեսկզբին իր աշխատանքների ավելի քան 10-օրյա դադարը ապօրինի է՝ մի քանի նախկին աշխատողների մեղադրելով սաբոտաժի և ինքնիրավչության մեջ։ Այդ մեղադրանքը հասցեագրելու մեզ հայտնի քաղաքակիրթ միակ ձևը դատական քննությունն է։ Դատական քննությունը կպարզի հիմնավոր, թե անհիմն է մեղադրանքը, և եթե մեղադրանքը հաստատվի ՀՀ շահերից է բխում, որ երկրի տնտեսությանը զգալի վնաս հասցրած գործողությունների գնահատականը տրվի իրավական դաշտում։

Նույն տրամաբանությամբ կարևոր ենք համարում հակադարձել հանքարդյունաբերական ընկերությունների կողմից տարբեր ակտիվիստական կազմակերպությունների և անհատների դեմ զրպարտության մեղադրանքով հայցերը որպես ճնշում ներկայացնելու փորձերին։ Տարիներ, նույնիսկ տասնամյակներ շարունակ հանքարդյունաբերական ոլորտի ընկերությունների հասցեին հնչել են զրպարտչական, կեղծ, հակագիտական հայտարարություններ։ Հանքարդյունաբերական ընկերությունների արձագանքին չարժանացած այս հայտարարությունները հետագայում օգտագործել և օգտագործում է Ադրբեջանը՝ Հայաստանի դեմ։ Սա վկայում է այն մասին, որ ցանկացած նման հայտարարությանը իրավական դաշտում հակադարձելը ոչ միայն հանքարդյունաբերական ընկերությունների իրավունքն է, այլև բխում է երկրի շահից։ Եթե մեղադրանքն անհիմն է, ապա քաղաքացիական հասարակության ներկայացուցիչներին ոչինչ չի խանգարում իրենց հայտարարություններն ապացուցող փաստեր ներկայացնել դատարանում։ Դատական կարգով վեճերի լուծումը իրավական պետության հիմնաքարային բաղադրիչ է։ Դատական հայցը չի կարող համարվել ճնշում։ Այն սեփական իրավունքները քաղաքակիրթ ճանապարհով պաշտպանելու բոլորի սահմանադրական իրավունքն է և մեզ հայտնի միակ իրավական ճանապարհը։ Եթե քաղաքացիական հասարակության ներկայացուցիչները զրպարտությունից պաշտպանվելու այլ ճանապարհներ գիտեն, պատրաստ ենք լսել նրանց առաջարկները։
