Վերաքննիչ քրեական դատարանը երեկ որոշում է կայացրել ահաբեկչության և իշխանության յուրացման նախապատրաստության համար մեղադրվող Հրայր սարկավագ Հակոբյանին ազատ արձակելու վերաբերյալ։ Հակոբյանն արդեն երեկ երեկոյան ազատ է արձակվել քրեակատարողական հիմնարկից։ Դատարանը բավարարել է խափանման միջոցը փոխելու միջնորդությունը և բացակայելու արգելք ու վարչական վերահսկողություն սահմանել։

Հրայր սարկավագը ձերբակալվել էր «Սրբազան պայքարի» առաջնորդ Բագրատ արքեպիսկոպոս Գալստանյանի հետ միասին՝ նրա տնից, մեղադրելով ահաբեկչության և իշխանության յուրացման նախապատրաստություն կատարելու հոդվածով։

Իշխանությունները նույնիսկ ձայնագրություն էին տարածել, իբր Հրայր սարկավագը մի քանի բարձրաստիճան պաշտոնյաների սպանություն է նախապատրաստում։ Վերաքննիչ քրեական դատարանի որոշումը կայացրած դատավորը Վազգեն Ռշտունին է, ով փաշինյանական իշխանության 7 տարիների ընթացքում երբեք չի ճկվել իշխանությունների առջև և մշտապես արդարացի վճիռներ է կայացրել։ Երեկ էլ այս վճռի հրապարակումից հետո իսկական վայնասուն բարձրացավ իշխանության և մերձիշխանական շրջանակներում։ Գործող իշխանություններին էլ սկսեցին մեղադրել վեթինգ չիրականացնելու, դատական իրավական համակարգը ընդհուպ նախկինների ձեռքում թողնելու մեջ։

Մի կողմ թողնենք այն հանգամանքը, որ եթե Ռշտունու դեմ որևէ բան ունենային, գործող իշխանությունները վաղուց նրան հեռացրած կլինեին։ Դատական համակարգում ամենաբարձր վարկանիշ ունեցող դատավորներից մեկը քանիցս ապացուցել է, որ չի կատարում փաշինյանական իշխանության պահանջները, և նա եզակի մնացած դատավորներից է, որ կարողանում է պաշտպանել իր դիրքորոշումները։

Նույնիսկ, եթե հաշվի առնենք, որ քննադատությունները արդարացված են, ապա դա ևս մեկ անգամ խոսում է գործող իշխանությունների սովորական ձախողման վերաբերյալ, որոնք գալով իշխանության, մի օր էլ նույնիսկ շրջափակելով դատարանները, փորձում էին դատաիրավական համակարգը ամբողջությամբ մտցնել իրենց վերահսկողության տակ։ Ի դեմս Ռշտունու՝ դատական համակարգում կան դատավորներ, ովքեր չեն պարում իշխանության դուդուկի տակ և ցույց են տալիս, որ կարող են արդարացի վճիռ կայացնել, իսկ իշխանությունների և նրանց սատարող ու ծառայող քաղաքական ուժերի և փորձագետների բարձրացրած վայնասունն առաջիկայում ավելի է սրվելու։
