Դատարանը մերժել է Աղվան Արշակյանի պաշտպանների միջնորդությունը՝ անընթեռնելի և անորակ փաստաթղթերի հիմքով

Երևանի ընդհանուր իրավասության դատարանը մերժել է մեղադրյալ Աղվան Արշակյանի խափանման միջոցի փոփոխության վերաբերյալ պաշտպանական կողմի ներկայացրած միջնորդության վարույթը՝ փաստաթղթերի ոչ պատշաճ որակի պատճառաբանությամբ։

Միջնորդության հիմքում նշվել էր Արշակյանի առողջական վիճակի հնարավոր վատթարացումը։ Սակայն դատարանը գտել է, որ ներկայացված բժշկական փաստաթղթերում բացակայում են օբյեկտիվ տվյալներ, որոնք կվկայեին մեղադրյալի առողջական վիճակի այնպիսի վատթարացման մասին, որը կարող էր արդարացնել կալանքի վերացումը կամ այլընտրանքային խափանման միջոցի կիրառումը։ 

Ըստ Փաստ֊ին փոխանցված որոշման՝ «ամբուլատոր քարտի պատճենի որակով պայմանավորված՝ մասնագիտական զննման տվյալները անընթեռնելի են, ներկայացված մյուս փաստաթղթերում բացակայում են այդպիսի տվյալներ»։

Դատարանն անդրադարձել է նաև պաշտպանական կողմի պնդմանը, թե քննիչը անտեսել է առողջական վիճակի անհապաղ փորձաքննություն նշանակելու պահանջը՝ նշելով, որ դա չի կարող համարվել նոր էական հանգամանք ՀՀ քրեական դատավարության օրենսգրքի 289-րդ հոդվածի իմաստով։ 

Միևնույն ժամանակ որոշման մեջ նշվում է, որ ներկայացված փաստաթղթերի տեխնիկական խնդիրների լուծման պարագայում նոր միջնորդության ներկայացման արգելք չկա։

Մեր տեղեկություններով՝ պաշտպանական կողմը դատարան է ներկայացրել արդեն տեխնիկապես պատշաճ ձևավորված փաստաթղթեր, և դրանց հիման վրա դատավորն ընդունել է նոր միջնորդությունը վարույթ։
