«Փաստ» օրաթերթը գրում է.

2025 թվականի օգոստոսի 8-ից ապօրինի կալանավորված է ՊԵԿ նախկին նախագահ Վարդան Հարությունյանը: Իրավաբանների կարծիքով, այս գործում չափազանց շատ են նախկինում տեղի չունեցած հանգամանքները: Դրանցից մեկն այն է, որ գլխավոր դատախազն առանց որևէ նոր հանգամանքի վերացրել է կարճված քրեական վարույթը և 7 տարի անց փաստացի վերակենդանացրել «մահացած» քրեական գործը:

Այս որոշումը նոր նախադեպ կարող է դառնալ, և որևէ մի ավարտված գործ փաստացի չի կարող դիտարկվել իրապես ավարտված: Նման որոշմամբ ազդակ է փոխանցվում քննիչներին և դատախազներին, որ իրենց որոշումները, որոնք ստուգվել են բոլոր ընթացակարգերով, ցանկացած պահի կարող են վերացվել, և քրեական վարույթներ կարող են հարուցվել հենց իրավապահների դեմ: Այս պայմաններում քրեական վարույթները, քրեական հետապնդումները կարող են դառնալ անորոշ կամ հավերժական: Նման փորձ որևէ եվրոպական երկրում չի եղել, քանի որ գործի վերաբացումը միայն բացառիկ նոր հանգամանքի դեպքում պետք է տեղի ունենա:

Շուրջ 70 օր կալանավորված Վարդան Հարությունյանի հետ կապված՝ քննիչները պնդում են գործին խոչընդոտելու ռիսկը, մինչդեռ, ի պատասխան մեր հարցմանը, փաստաբանական խմբից հայտնեցին, որ հենց իրենք իրենց նախաձեռնությամբ բազմաթիվ միջնորդություններ են ներկայացրել առերեսման կամ որևէ գործողության, որոնք պարզապես մերժվել են, քանի որ չի կարող լինել նման ռիսկ, որովհետև նույնիսկ առկա չէ հիմնավոր կասկած մեղադրանքների վերաբերյալ: Այսինքն, փաստացի առանց իրավական հիմքի պահպանվում է Վարդան Հարությունյանի կալանքը: Ընդհանրապես, չափազանց վտանգավոր նախադեպ է նաև այն, որ քննիչների կողմից պնդում է կատարվում նախաքննությանը խոչընդոտելու վերաբերյալ, սակայն որևէ գործողություն չկատարելով՝ արհեստականորեն փորձում են պահպանել կալանքը: Մարդու իրավունքների եվրոպական դատարանը նման դեպքերի վերաբերյալ բազմիցս արձանագրել է նաև հենց Հայաստանի դեմ վճիռներով, որ շուրանակվող կալանքը պետք է լինի ծայրահեղ պատճառաբանված, և կանխավարկածը պետք է լինի հօգուտ անձի ազատ արձակման: Փաստաբանները մեզ հայտնեցին, որ ստացել են դատարանի որոշումը, համաձայն որի, կալանքը երկարաձգվել է մեկ ամսով, սակայն Եվրոպական դատարանի պահանջած ոչ մի չափանիշ չի պահպանվել
