Արդեն 177 օր է՝ Սամվել Կարապետյանն ապօրինի կալանավորված է. հրավիրված ասուլիսին ասաց բարերար, գործարար Սամվել Կարապետյանի փաստաբանական խմբի անդամ Արամ Վարդևանյանը։

Նա նշեց, որ սովորաբար փաստաբանները փորձում են շահերի պաշտպանություն իրականացնել՝ հենվելով իրավունքի և օրենքի վրա․ «Բայց Սամվել Կարապետյանի գործով իրավունք, օրենք ընդհանրապես չի գործում, իրավունքի և օրենքի ոչնչացման վարքագիծ են դրսևորում»,-ասաց նա։

Փաստաբանը կրկնեց, որ այս գործով առկա է քաղաքական հետապնդում, վրեժխնդրություն. «Փաստացի Սամվել Կարապետյանը քաղաքական պատանդի կարգավիճակ ունի»։

Վարդևանյանը հիշեցրեց, որ Կարապետյանի դեմ գործը հիմնավորվում է ՀՀ ամենաբարձր պաշտոն զբաղեցնող անձի հունիսի 17-ի հրապարակային գրառմամբ։ «Պարզապես կարելի է վերցնել Քրեական դատավարության օրենսգիրքը, նշել Սամվել Կարապետյան անունը և փակել օրենսգիրքը, որովհետև այն չի գործում՝ 177 օր շարունակ։ Վերաքննիչ դատարանը՝ նախագահությամբ Ժենյա Մելիքսեթյանի, ուներ բոլոր հնարավորությունները՝ ցույց տալու, որ այս ամենն իրականության հետ առնչություն չունեն»,-ասաց նա։

Փաստաբանը հավելեց, որ գլխավոր դատախազն ու քննիչը համատեղ են գործում և հիշեցրեց, որ Կարապետյանի դեմ հաղորդում կոչվածը ներկայացրել է գլխավոր դատախազ Աննա Վարդապետյանը և այդ պնդումը քննիչը կատարում է մինչ օրս։

«Չեն կարողանում մեկ փաստարկ ներկայացնել, թե ինչի համար Սամվել Կարապետյանը պետք է լինի կալանավորված, բայց կալանավորված է, որովհետև ՀՀ դատավորները՝ կոնկրետ անուն ազգանունով, որոնք պետք  է հանդես գան պատվարժան դատարանի անունից, չեն իրականացնում արդարադատություն»,-ասաց նա։

Վարդևանյանը նշեց, որ կարող են հետագայում պատճառաբանել, թե քաղաքական հետապնդում էր, ճնշման մթնոլոր էր և չէին կարողանում լինել անկախ․

«Բազմաթիվ պատճառաբանություններ կարող են բերել, բայց ինչ կապ ունի դա օրենքի հետ։ Ի վերջո, լինում են գրավոր որոշումներ, որոնք պահպանվում են, այդ որոշումները ևս ունեն պատասխանատուներ։ Եթե մի դատավոր պետք է վկայակոչի, թե ինչ անասելի ճնշումներ են եղել, իրավական զրո նշանակություն ունի այդ փաստարկը կամ պատասխանը, որովհետև որոշման եզրափակիչ մասում միշտ գրվում է դատավորի անունը և ազգանունը, և այդ ամենը պահպանվում է։ Պատասխանատվության անխուսափելիության սկզբունքը կա, լինելու է և գործելու է»։
