Հակակոռուպցիոն դատարանի խոսնակը «Ազատության» հետ զրույցում հայտնեց, որ «Մարտի 1»-ի գործով մեղադրյալ, նախկին պաշտպանության նախարար Սեյրան Օհանյանն չի ներկայացել այսօրվա դատական նիստին։ Այդ պատճառով դատավորը որոշում է կայացրել նրան բերման ենթարկելու մասին։

Հիշեցնենք, որ 2008թ․ մարտի 1-ի իրադարձություններին առնչվող՝ իբրև սահմանադրական կարգի տապալման գործով մեղադրյալի կարգավիճակում էին ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանը, ՀՀ ԶՈՒ նախկին գլխավոր շտաբի պետ, ՀԱՊԿ նախկին գլխավոր քարտուղար Յուրի Խաչատուրովը, ՀՀ պաշտպանության նախկին նախարար Սեյրան Օհանյանը և ՀՀ նախկին փոխվարչապետ Արմեն Գևորգյանը։ Յուրի Խաչատուրովը և Սեյրան Օհանյանը մեղադրվում էին սահմանադրական կարգը տապալելու համար, Ռոբերտ Քոչարյանը՝ ՀՀ սահմանադրական կարգը տապալելու և առանձնապես խոշոր չափերով կաշառք ստանալու, իսկ Արմեն Գևորգյանը՝ ՀՀ սահմանադրական կարգը տապալելուն օժանդակելու, առանձնապես խոշոր չափերով կաշառք ստանալու և հանցավոր ճանապարհով ստացված գույքն օրինականացնելու համար։

ՍԴ-ի կողմից՝ 2021թ․ մարտի 26-ին ՀՀ Քրեական օրենսգրքի (2003թ․) 300,1-րդ հոդվածը Սահմանադրության 78-րդ և 79-րդ հոդվածներին հակասող և անվավեր ճանաչելուց հետո Երևանի ընդհանուր իրավասության դատարանը՝ դատավոր Աննա Դանիբեկյանի նախագահությամբ, սահմանադրական կարգի տապալման դրվագով կարճել էր քրեական գործը և դադարեցրել քրեական հետապնդումը՝ հանցադեպի բացակայության հիմքով, թեև դատախազները պահանջում էին վերաորակել արարքը։ Դատախազության վերաքննիչ բողոքը մերժվել է, իսկ Վճռաբեկ դատարանը դիմել էր ՍԴ՝ վիճարկելով Քրեական դատավարության օրենսգրքի մի շարք հոդվածների Սահմանադրությանը համապատասխանելու հարցը: Խնդիրը 1998-ին ընդունված, այժմ մասնակի գործող Քրեական դատավարության օրենսգրքի 309.1 հոդվածի 3-րդ մասն էր, որը հնարավորություն չէր տալիս հոդվածը հակասահմանադրական ճանաչելուց հետո դատարանում վերաորակել մեղադրանքը:

ՍԴ-ն որոշել է մասնակի բավարրարել դիմումը՝ նշելով, որ թեև հոդվածը համապատասխանում է Սահմանադրությանը, այն մեկնաբանությամբ, որ ամբաստանյալին մեղսագրվող արարքը հակասահմանադրական ճանաչվելիս մեղադրողը կարող է մինչև դատարանի խորհրդակցական սենյակ հեռանալը փոխել ամբաստանյալին առաջադրված մեղադրանքը մեղադրյալի արարքում քրեական օրենքով նախատեսված այլ արարքի հատկանիշների առկայության պարագայում՝ անկախ դատական քննության ընթացքում ապացույցների հետազոտումից: Վճռաբեկ դատարանը որոշել է բավարարել դատախազության բողոքը։
